1. Acceptance of Terms

By accessing or using the ProductTryOn website (producttryon.com), software, APIs, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.

2. Description of Services

ProductTryOn provides an embeddable virtual try-on widget and API that enables ecommerce merchants to offer AI-powered product visualization on their online stores. The Services include the widget, merchant dashboard, analytics, API access, and related tools.

3. Account Registration

To use certain features of the Services, you must create an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity under your account.

4. Subscription and Payment

• Paid plans are billed monthly or annually in advance. Prices are listed on our pricing page and may change with 30 days notice to existing subscribers.
• Free trials provide full access for the stated trial period. No credit card is required to start a trial. If you do not subscribe before the trial ends, your account will be downgraded to a limited free tier.
• Payments are processed by Stripe. By subscribing, you agree to Stripe's terms of service.
• Refunds may be issued at our discretion for billing errors or if the Services fail to perform as described for a sustained period.

5. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law
• Reverse-engineer, decompile, or disassemble any part of the Services
• Interfere with or disrupt the integrity or performance of the Services
• Use the Services to collect, store, or process biometric data in a manner that violates applicable privacy laws
• Resell, sublicense, or redistribute the Services without written permission
• Upload product content that infringes intellectual property rights of third parties

6. Intellectual Property

The Services, including all software, designs, text, and AI models, are owned by ProductTryOn and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Services for your ecommerce operations during your subscription period.

You retain all rights to your product images, brand assets, and store content. By uploading product images, you grant us a limited license to process them for the purpose of generating try-on assets.

7. Customer Photo Processing

End-customer photos are processed in-browser on the customer's device. As a merchant using our Services, you agree to inform your customers that virtual try-on processing occurs on their device and that photos are not stored unless explicitly saved by the customer. You are responsible for maintaining an appropriate privacy policy on your store that covers the use of virtual try-on technology.

8. Service Availability

We strive to maintain 99.9% uptime for the Services but do not guarantee uninterrupted availability. Scheduled maintenance will be communicated in advance when possible. Enterprise plan customers receive SLA guarantees as defined in their service agreement.

9. Limitation of Liability

To the maximum extent permitted by law, ProductTryOn shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability for any claim arising from these Terms or the Services shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that virtual try-on renderings will be perfectly accurate representations of physical products.

11. Indemnification

You agree to indemnify and hold harmless ProductTryOn and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

12. Termination

Either party may terminate the subscription at any time. Cancellation takes effect at the end of the current billing period. We may suspend or terminate your account immediately for material breach of these Terms. Upon termination, your right to use the Services ceases and we will delete your data within 30 days, except as required by law.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered merchants at least 30 days before taking effect. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
