Terms of Service

Effective August 14, 2026

1. Agreement

By installing, accessing, or using ProductTryOn, you agree to these Terms and our Privacy Policy. You represent that you can bind the merchant or organization using the service.

2. Service

ProductTryOn provides catalog configuration, a storefront theme app extension, virtual try-on image generation, and related usage reporting. Generated images are estimates for visualization and are not guarantees of fit, sizing, color, texture, or product performance.

3. Shopify installation

For Shopify stores, installation, authentication, permissions, and recurring charges are handled through Shopify. You authorize the app to use the permissions shown during installation. You are responsible for maintaining a supported Shopify store and enabling the ProductTryOn app block in a compatible Online Store 2.0 theme.

4. Plans, trials, and billing

Available plan prices and billing intervals are shown in the app before approval. Shopify bills approved Shopify subscriptions on the merchant's Shopify invoice. Trials apply only when displayed in Shopify's approval screen. Plan changes and cancellations are handled in the app or through Shopify and take effect according to the approval or cancellation terms shown there.

5. Merchant responsibilities

You must have the rights and permissions needed for product content and shopper image processing; provide accurate storefront disclosures and obtain consent where required; configure the service only for supported products; review generated results before relying on them; and comply with applicable consumer, privacy, biometric, advertising, and ecommerce laws.

6. Acceptable use

You may not use the service unlawfully; submit content you do not have the right to process; attempt to identify people from images; develop facial recognition or biometric profiles; bypass usage or security controls; interfere with the service; probe other merchants' data; resell the service without permission; or use generated output to mislead shoppers.

7. Data and licenses

You retain rights in merchant product content. You grant ProductTryOn and its processors a limited license to retrieve, transmit, transform, and display that content and submitted shopper images only as needed to operate, secure, and support the service. Data handling is described in the Privacy Policy.

8. Intellectual property

ProductTryOn and its licensors own the service, software, branding, documentation, and models or integrations they provide. These Terms grant a limited, non-exclusive, non-transferable right to use the service during an active installation or subscription.

9. Availability and changes

We may maintain, update, suspend, or change parts of the service to improve security, reliability, legal compliance, or functionality. We do not promise uninterrupted or error-free operation. Material plan or service changes will be communicated through an appropriate channel.

10. Suspension and termination

You may uninstall or cancel as permitted through Shopify. We may suspend or terminate access for material breach, security risk, unlawful use, nonpayment, or where required by law. On termination, storefront functionality stops and data is handled according to the Privacy Policy and Shopify privacy webhooks.

11. Disclaimers

To the extent permitted by law, the service and generated outputs are provided as available without warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded.

12. Limitation of liability

To the extent permitted by law, ProductTryOn is not liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages. ProductTryOn's aggregate liability arising from the service will not exceed the fees paid for the service during the twelve months before the event giving rise to the claim. This limit does not apply where prohibited by law.

13. Indemnity

You will defend and indemnify ProductTryOn against third-party claims arising from your unlawful use, merchant content, storefront disclosures, violation of these Terms, or infringement of another party's rights, to the extent permitted by law.

14. General

These Terms and referenced policies form the agreement for the service. If one provision is unenforceable, the remainder continues. Failure to enforce a provision is not a waiver. You may not assign the agreement without consent; we may assign it with a business transfer or reorganization. Governing law and venue will be determined by the contracting ProductTryOn entity and mandatory local law.
